USA: Alleged union-busting at Porpiglia farms prompts union to file unfair labour practice charge; incl. co. comments

United Farm Workers Union released a statement in August 2023 regarding alleged union-busting tactics by Porpiglia Farms in New York impacting their Jamaican and Mexican workers on H-2A temporary visas. On August 21, a UFW-led meeting in farm workers' living quarters was allegedly "forcibly raided and broken up" by Porpiglia Farm owners who physically and verbally intimidated the union representative into leaving the meeting. the union described how the aggressive and threatening behaviour was intended to limit workers from speaking with union organisers who were afraid of retaliation. Times Union reports that farmworkers have the right to receive visits in their living quarters.

The Porpiglia owners have said argued the union was improperly established. A certification issued by the Public Employment Relations Board contradicts the claim and states that UFW was designated and selected by a majority of employees, representing all workers including H-2A workers.

UFW previously filed an unfair labour practice charge on 4 August regarding a group of H-2A workers who were not called to work at the farm, allegedly in retaliation for forming a union.

The bosses’ aggressive and threatening effort to limit workers from speaking with union organizers only underscores what we believe to be deeply unjust, exploitative, and abusive status quo at Porpiglia Farms.
