Lake Turkana Wind Power lawsuit (re land rights, Kenya)
Quellen
Snapshot: In October 2014, representatives from Laisamis Constituency and Karare Ward in Marsabit County filed a lawsuit against Lake Turkana Wind Power (LTWP), the Marsabit County Government, the Attorney General, and the National Land Commission in the Environment and Land Court at Meru, Kenya. They claimed the wind power project "Lake Turkana Wind" violated land laws by not adhering to free, prior and informed consent protocols and failing to properly compensate for the land acquisition. LTWP did not dispute the irregular land acquisition process. On 19 October 2021, the court ruled that the land titles were irregularly obtained. LTWP sought a review in February 2022, citing new evidence and asking for an indefinite time extension to comply with the judgement. On 22 May 2023, the court rejected the review, leading to the cancellation of the land titles. Following this decision, LTWP appealed. The case is ongoing.
