Costa Rica: El Gobierno cuestiona la competencia de la CIADI en demanda de Infinito Gold

“Costa Rica señala falta de competencia del CIADI para tratar caso Infinito Gold” – 20 de agosto de 2014

El Estado de Costa Rica cuestionó ante el Centro Internacional de Arreglo de Diferencias Relativas a Inversiones (CIADI), del Banco Mundial, que ese órgano no tiene competencia para resolver una demanda millonaria…[que] Infinito Gold…presentó…contra Costa Rica por el fallido proyecto de minería a cielo abierto en Cutris de San Carlos…[donde] Infinito Gold pretendía construir una mina, pero los tribunales de justicia de Costa Rica anularon la concesión, los permisos y un decreto ilegal…que declaraba de interés público y conveniencia nacional dicho proyecto. El ministro de Comercio Exterior (Comex), Alexander Mora, informó que ante la respuesta costarricense a la demanda de Infinito Gold, el CIADI procedió a crear un Tribunal Arbitral, que definirá si el organismo adscrito al Banco Mundial es o no competente para llevar el litigio…Entre tanto, el dirigente ambientalista y legislador…Edgardo Araya, aseguró que “El Estado no debe ir arbitraje…[por]que los arbitrajes sólo proceden en los casos en que  “ningún tribunal costarricense haya emitido un fallo relativo a la medida que se alega contraviene este Acuerdo” (Inciso 3, artículo XII). ..
