要 点

1、在UFLPA开始执行后,CBP将根据具体情况审查每批货物是否落入UFLPA的管辖范围。如果进口商被告知商品依据UFLPA被扣留(detention)、排除(exclusion)或者扣押(seizure),进口商可以向 CBP 提供清晰且有说服力的证据,要求对 UFLPA 的可反驳推定进行例外处理(exception)。

2、进口商可以提交防止或减轻强迫劳动风险并纠正在开采、生产或制造进口商品时发现的任何强迫劳动的内控措施证据;并且企业经营系统或会计系统(例如经审计的财务报表)必须能够显示这些措施的对应信息,即相关措施需要在公司管理系统或会计记录中有迹可循。

3、UFLPA下的执法机制与CBP此前沿用的WRO是两个独立的机制。对于落入UFLPA管辖范围的商品,CBP将不会印发WRO,而是在逐批商品基础上进行执法,直接对商品进行扣留、排除、扣押处理,或者对满足反驳推定标准的商品作例外放行处理。
