The [Secretary-General’s Special Representative on Business and Human Rights (SRSG)] has identified investment, and in particular host government agreements (HGAs) — the agreements signed by foreign investors and host states for an investment project — as one key issue for the state duty to protect human rights and as directly relevant to the corporate responsibility to respect human rights. In line with his new mandate, the SRSG convened a group of experts to explore the feasibility of producing specific recommendations about how HGAs can be geared to achieve appropriate investor protection while ensuring that states keep the necessary policy space to fulfill their duty to protect human rights, and that investors respect human rights.
