Snapshot: In 2018, representatives of the Indigenous group Unión Hidalgo, supported by the NGO ProDESC, filed a lawsuit against Mexico's state power utility Comisión Federal de Electricidad (CFE) in front of Oaxaca’s First District Court. They argued that the parties signed a secret agreement to divide the local community and stimulate conflict. They further argued that land was seized without authorisation and adequate consultation of the communities, specifically under the principle of free, prior and informed consent. In 2021, the court ruled in favour of the Indigenous group, banning the wind farm construction on Indigenous lands. In June 2022, in response to the court ruling, CFE cancelled the Gunaa Sicarú wind farm power supply contract with EDF. The case is closed.
