"De Xin Myanmar Garment Factory Forced to Work Excessive Overtime", 17 July 2024
...De Xin Myanmar Garment Factory, located at No. 1, Thein Chaung Road, Wa Thara Industrial Zone, Shwe Pyi Thar Township, Yangon Region, is facing difficulties due to excessive overtime and labor violations, according to workers.
The factory employs around 500 workers, but there is no labor union or WCC.
The brands it produces [for] include Prenatal / SOULCAL & CO / VOYAGER, and the business has been operating for more than 2 years.
The workers' normal working hours are from 8 am to 6:30 pm, including 2 hours of overtime.
"Some weeks, we work 10 hours a day, including 2 hours of regular overtime. Some weeks, we have to work overtime, such as from 9 pm to 12 am....[they] do not ask [for] workers' [consent], [and] force them to work....The workers are not satisfied with the salary they receive, so they have to work overtime every time they call them," the worker said.
The wage payment is set in stages, from 4,800 per day + 1,000 kyats, a subsidy of 30,000 kyats, a regular daily wage of 50,000 kyats, and a grand severance pay of 35,000 to 65,000 kyats, and the grand severance pay is determined after at least 3 months of service.
Despite this wage rate, if they miss a day for various reasons, they cannot take the leave, and their daily wage and regular wage of 25,000 kyats are deducted, and their grand severance pay of 35,000 kyats is deducted, and if they miss two days, their regular daily wage is deducted...
"I can't take leave because I'm sick, I can't take leave for my parents' illness, I can't take leave for weddings, etc. Even if the worker applies for leave, they say they can't because they haven't signed an EC contract yet. Even if they do, they don't give me leave...," the worker said.
Social security contributions have been deducted from workers at a set rate since the company started operating, and the new manager issues social security cards based on the date they actually started working, not the date they received the social security card. This means that there are grievances for the salaries that have had social security contributions deducted.
There is no medical room at the workplace, the toilets are not clean, there is no safety, and during meals, they are having difficulty because managers...shout at them and kick things.
The workers said they want to address these workplace violations.
- Workers should be given the days off they are entitled to if they apply for leave.
- Workers should not [have] their leave entitlements and wages [deducted] if they miss work.
- Workers should not [have] their wages [deducted] if they apply for leave without permission.
- Prioritize workplace safety and provide medical facilities and worker rest rooms.
- Provide clean cafeterias for workers and provide enough tables and chairs for eating and drinking.
- If overtime is required, workers should be consulted...
