We are excited to present the first BCSDN research on Strategic Lawsuits Against Public Participation (SLAPPs) in the Western Balkans titled “From Silence to Strength: A Regional Response to SLAPPs in the Western Balkans”.

The report:

• Provides data on SLAPPs from all six Western Balkan countries
• Presents case studies and diverse SLAPPs tactics used by defendants and plaintiffs
• Analyzes legal frameworks across WB, identifies, gaps, and challenges
• Empowers stakeholders to recognize and resist SLAPPs
• Raises awareness among policymakers and civil society
• Offers targeted recommendations to combat SLAPPs

Key Insights:

• SLAPPs are a growing trend across the region.
• Bosnia and Herzegovina, Serbia, and North Macedonia have seen a notable increase in SLAPP cases, while Montenegro has experienced a decrease following judicial reforms and increased training on European Court practices and the decriminalization of defamation.
• Current legal frameworks are insufficient for timely and effective protection against SLAPPs.
• SLAPPs exploit existing legal systems, leading to self-censorship and chilling public discourse.
• Lengthy legal battles and bureaucratic delays burden defendants.
• SLAPPs threaten democratic engagement and public participation.

Urgent Needs for combating SLAPPs (our recommendations):

• A clear definition of SLAPPs and criteria for early identification and dismissal.
• Effective strategies and legal frameworks to combat SLAPPs and safeguard civic space.
• Legal reforms to make recognition and dismissal of SLAPPs straightforward.
• Streamlined legal processes and consistent judicial rulings.
• Specialized training for judges and legal professionals.
• Educational and capacity-building activities for stakeholders.
• Rigorous monitoring, advocacy for reforms, and raising awareness.
• Regional and international collaboration and alliance-building.
• Support mechanisms like legal aid, financial assistance, and psychological support for SLAPP victims.

The comprehensive efforts outlined in this report by BCSDN and its member organizations are crucial steps toward empowering stakeholders in the Western Balkans to recognize and resist attempts to silence dissent and curtail civic engagement.
