"NLRB Issues Additional Consolidated Complaint over ASARCO's Unfair Labor Practices", 1 October 2020

Region 28 of the National Labor Relations Board has issued an additional consolidated complaint against ASARCO after investigating our charges that the company failed to reinstate workers returning from the unfair labor practice strike and kept replacement workers and crossover employees in the returning strikers’ jobs. The case is now set for a trial to begin on January 20, 2021. Our unions notified ASARCO that we were ending the strike, ceasing all picketing activity and making an unconditional offer to return to work, effective July 6...

On August 13, we submitted our statement of position to NLRB Region 28 seeking to compel the company to return workers to their rightful jobs, expel the replacement workers from our facilities and make whole those who are deprived of wages and benefits by the company's continued unlawful actions. In its previous complaint against ASARCO, the NLRB outlines management’s overall failure to bargain in good faith with the unions representing its employees, including failing to provide information needed for bargaining, failing to have decision makers at the table, changing an existing bonus program to discriminate against union representatives, unlawful surveillance and unilaterally declaring an impasse and implementing changes to working conditions in December 2019...
