XPO Logistics Europe served letter of formal notice challenging inadequacy of its vigilance plan under French Duty of Care Law

On 1 October 2019, in a landmark legal move, the International Transport Workers’ Federation (ITF), the European Transport Workers’ Federation (ETF) and an alliance of unions served a letter of formal notice to XPO Logistics Europe under the French Corporate Duty of Vigilance Law. XPO's European arm falls within the remit of the Law. According to an ITF analysis, XPO’s current vigilance plan does not fulfil the mandatory requirements set out by the law, nor were unions consulted with in relation to the plan. Under the law, XPO has three months to fulfil its obligations or the network will bring the matter before the relevant jurisdiction in France. It is the first time the law is being used to hold to account a global transport company.
