India: Amid ongoing conflict in Gaza, report finds Indian companies continue to supply arms to Israel

On April 5, India abstained from voting on a UN Human Rights Council (UNHRC) resolution urging an immediate ceasefire in Gaza and an arms embargo on Israel, a stark contrast to its earlier vote in favor of a UN General Assembly resolution for a Gaza ceasefire on December 12, 2023. This shift in policy appears to be influenced by the resolution's call for an arms embargo on Israel.

India on May 10, 2024 voted in favour of a draft U.N. General Assembly resolution that said Palestine is qualified and should be admitted as full member of the United Nations and recommended that the Security Council “reconsider” the matter “favourably”

Despite mounting international criticism of the Israeli Defence Forces' actions in Gaza and accusations of genocide, the Indian government, which has been supplying weapons to Israel, seems intent on maintaining its munitions exports to the country. Media reports since early February 2024 reveal that Adani-Elbit Advanced Systems India Ltd. (AEAS), Munitions India Ltd. (MIL), and Premier Explosives Ltd. (PEL) continued to supply arms to Israel despite calls for a humanitarian ceasefire and an end to arms sales.

In a recent case brought before the International Court of Justice by Nicaragua against Germany for its arms sales to Israel during the conflict, the ICJ underscored the importance of all states adhering to their international obligations regarding arms transfers to parties involved in armed conflicts, emphasizing the risk of such arms being used to violate international conventions, including those pertaining to genocide and the Geneva Conventions. Given India's status as a party to both Conventions, it bears a similar obligation.

PEL responded to the The Wire, while the others did not. The Business & Human Rights Resource Centre thus invited Adani-Elbit Advanced Systems India Ltd. and Munitions India Ltd. to respond to the allegations and to share the steps the company has taken to divest from continued arms sales to Israel. Neither company responded.
