[T]he complainants are strongly opposing the construction of any hydro power schemes in the Mekong river and have, therefore, chosen to include in their complaint a lot of selected, guessed and unprofessional details to support their view. The complainants’ allegations are partly based on a misinterpretation of the application of the OECD Guidelines for Multinational Enterprises...and on wrongful interpretations of the recommendations given in them. The complainants have also misinterpreted the procedures agreed in the Agreement on the Cooperation for the Sustainable Development of the Mekong River Basin...[T]he mere fact that there is a scientific disagreement does not mean that Pöyry Energy...would not have been compliant with the recommendations of the OECD Guidelines...Pöyry sees that the allegations and demands of the complainants are unfounded and without any basis in the OECD Guidelines.
