Over the past few months, the movement against gender-based discrimination in the workplace has gained momentum at a seemingly unprecedented pace. Mass mobilization against sex discrimination, including sexual harassment, through movements like #MeToo and #TimesUp, spans across multiple industries and sectors of business, politics, entertainment, and sports. The movement is not only culturally powerful, it is also legally significant. (…)
The MeToo movement not only depicts a cultural tipping point around the globe in how it is changing mindsets, but it has the potential to significantly shift judicial and legal processes. Despite the many unknowns, and the need to address the shortcomings of litigation such as cost and the exclusion of low-income workers, the way in which court rooms have connected with the broader social movement is paving the way for increased accountability of employers.
