Up to thirty homeless persons are reportedly at risk of being forcibly expelled from Miyashita Park, a publicly owned park that has been leased for private development to Mitsui Fudosan (Mitsui Real Estate), a major real estate developer. 

The Tokyo ward of Shibuya awarded a contract to Nike Japan in 2009 to develop Miyashita Park. This contract was later declared void by a court ruling, which also awarded damages to some of the homeless people who had been forcibly expelled from the park at that time. However, Shibuya then awarded another contract, this time to Mitsui Fudosan, and plans are going forward for construction of a large hotel, despite the objections of the homeless residents. 

Business & Human Rights Resource Centre invited Mitsui Fudosan to respond to the allegations, but received no response. According to the residents, Mitsui Fudosan has refused to enter into any communication with them.
