Ukraine: Sukha Balka to pay former worker UAH 300,000 in moral damages caused by occupational disease

PERSON_1 filed a lawsuit against Private Joint Stock Company Sukha Balka for compensation of moral damages due to the impairment of the plaintiff’s health.
He justified his claim by stating that he had been in an employment relationship with the defendant, PJSC Sukha Balka, for over 12 years in various positions, as a result of which he developed an occupational disease.
According to the conclusion of the Medical and Social Expert Commission (MSEC) dated April 30, 2024, he was initially assigned 65% loss of professional working capacity and Group III disability.
The court ruled to partially satisfy the claim of PERSON_1 against Private Joint Stock Company Sukha Balka for compensation of moral damages caused to the employee due to health impairment.
To recover from Private Joint Stock Company Sukha Balka in favor of PERSON_1 moral damages in the amount of 300,000 hryvnias, without withholding personal income tax.
