Snapshot: In June 2023, three resident groups (Save Long Beach Island”, “Defend Brigantine Beach”, and “Protect Our Coast NJ”) filed an appeal against the state of New Jersey in the US and Ørsted with the state's Superior Court. The lawsuit challenges the findings of the New Jersey Department of Environmental Protection (DEP) that Ørsted's wind farm project Ocean Wind 1 is consistent with New Jersey's obligation to protect the coastal environment under the New Jersey Coastal Zone Management Act despite some adverse impacts. The plaintiffs challenge this decision given that the DEP's report has acknowledged that "the wind turbines will destroy marine habitat, compress the seafloor,...cause commercial fishing stocks to decline, and injure the beach economy... ”

In October 2023, Ørsted withdrew from this wind farm project. The case is closed.
