Beaks & Suria Harmoni response re alleged SLAPP filed against news outlet Malaysiakini and political party PSM

First and foremost, we strenuously deny the untrue allegation that we have commenced lawsuit as “Strategic Lawsuits Against Public Participation” (hereinafter referred to as “SLAPPs”) to silent, stop or slow the work of human rights defenders or any party.

Conversely, we merely commenced the lawsuit against the Defendants in the present case to protect our interests as well as claiming for the damages towards the untrue and unjustifiable defamatory statements made against us.

Despite the fact that the Honourable Court did set aside our Ad Interim Injunction on 19.04.2024, the Learned High Court Judge never ruled that we have misused the current suit as SLAPPs per se.

At all material time, we are reputable construction companies and actively participated in various Government projects including the development of affordable housing projects for the benefits of our people whereby we have been granted quota by the relevant authorities to employ Bangladeshi workers to involve in our construction works inevitably.

In fact, we had indeed arranged jobs for the foreign workers as per our employment contracts, but they refused to accept the arranged jobs and wanted to work for other company instead.

Lately, we have been made to understand that a third party has instigated, manipulated and arranged our foreign workers to lodge police reports and complaints to labour office against us notwithstanding that we did not breach our contractual obligation towards the foreign workers.

Thereafter, various untrue and unjustifiable allegations have been made against us with the intention to lower our esteem and reputation, i.e. we have committed some serious crimes as well as violated rules, laws and regulations (which we vehemently deny)...
