[T]he Sami people had the right to be consulted, and Jillen-Njaarke district has been actively involved in the licensing process. The district´s priorities have been given considerable weight in the assessment by the NVE and the Ministry. As the district appealed the decision of NVE, the Ministry was required to make a final decision based on a thorough independent judicial assessment. The judicial report specifically addressed Sami rights, and concluded that the establishment of the Øyfjellet Wind Park is not in conflict with the UN convention on civil and political rights art. 27.
