Lawsuit filed against EDF for alleged failure to respect French duty of vigilance law over wind project in Mexico

BHRRC Renewable Energy & Human Rights Benchmark Briefing

Representatives of Unión Hidalgo, Mexican human rights organization ProDESC and European Center for Constitutional and Human Rights (ECCHR) have filed a civil lawsuit against EDF under the French duty of vigilance law. The plaintiffs allege that EDF violated the right to free, prior and informed consent (FPIC) of the local indigenous community impacted by the company's planned wind farm project in Mexico. The lawsuit seeks to prevent further violations of the community’s fundamental right to FPIC, as well as serious risks to their physical integrity.

This is the third lawsuit filed with French courts since the duty of vigilance law came into force in 2017.
