Eurasian Resources Group response

Thank you for your interest in our company.

I. In response to your inquiry concerning waste materialfrom the Aktobe Ferroalloys Plant, we can confirm that there was an instance of contractors breaching their health, safety, and environmental obligations in 2020. In the same year, a court ruling ordered Sailan Aktobe LLP, Zelenstroy LLP and KA2 Business Groups LLP, together with TNC Kazchrome JSC, to remove the waste previously transferred for disposal to these contractors from the Kazchrome site. Since the owners of these companies could not be found, Kazchrome removed the waste on its own accord. The waste was transported to a dedicated landfill at Aktobe Ferroalloys Plant and deposited in accordance with all applicable standards and regulations. Following the disposal of the waste material, the sites in question were cleaned and rehabilitated to a natural state. Contaminated soil was removed and replaced with clean soil. The sites were inspected by a Commission consisting of representatives of the Department of Ecology of the Aktobe Region, and statements were issued confirming that the waste had been removed and the sites cleaned.https://inbusiness.kz/ru/last/kazhrom-vyvez-vse-othody-kotorye-brosili-neblagonadezhnye-podryadchiki

It should be noted that after this negative experience, Kazchrome no longer outsources its waste recycling processes. Waste, including dust captured by gas scrubbers, is recycled, and disposed of in-house. In addition, ERG Recycling has been established to provide waste recycling services to the Group’s operations, including Kazchrome.

To avoid any misunderstanding regarding the safety and environmental performance of our operations, concerned local residents have been invited to the Aktobe Ferroalloys Plant and offered an opportunity to gain first-hand knowledge about the operation’s waste processing activities (see the briquetting line). https://amm.kz/ru/press-tsentr/novosti/novosti-blog/1321-obshchestvennikov-i-ekovolonterov-priglasili-na-aktyubinskij-zavod-ferrosplavov

ERG is open to the public and was the first company in Kazakhstan to offer guided tours of its industrial sites. Anyone can visit ERG’s operations - including the Aktobe Ferroalloys Plant - and learn about the Group’s environmental projects. We look forward to welcoming you as our guests.

II. ENRC is a separate entity to ERG. Concerning the supposition posited by the Business and Human Rights Resource Center regarding ENRC, we would encourage you to consider the ruling passed down by the High Courtof England and Wales in December 2023:https://www.cityam.com/uk-fraud-office-faces-hefty-bill-after-court-finds-wrongdoing-led-to-enrc-bribery-probe/.
