We have previously described both to Mining Watch Canada [MWC] and publicly that Barrick’s remedy framework to address incidents of deplorable sexual violence against women residing in the Porgera Valley in Papua New Guinea was developed over an 18-month period. This process included extensive consultation with numerous local, international and subject matter experts, including Human Rights Watch, Professor John Ruggie…and many others…MWC correctly points out that on May 16 2013, Barrick publicly released an amended version of the legal waiver provision accompanying resolutions of claims. Contrary to MWC’s claims, the language of the release was amended following consultation with international stakeholders and experts to ensure, consistent with international norms, that the language was narrowly tailored to the claim being resolved, did not preclude claimants from participating as witnesses in other matters, and excluded criminal proceedings…
