BHRRC invited Alico Farm to allegations of violations related to exposing workers to hazards associated with high ambient heat by Guerrero Ag, a labor contractor for the company. In particular, Alico Farm was requested to disclose the steps it has taken to investigate and provide remedy to workers for the abusive working conditions, any preventative measures implemented since the incident in 2023 to prevent such incidents from recurring, and due diligence it undertakes prior to entering into contracts with labor contractors.

Guerrero Ag. LLC. and all Independent Service Providers are required, as a condition to provide services to Alico, to ensure the safety and well-being of the Independent Service Provider’s employees as required by law and regulation. More specifically, each Independent Service Provider agrees to:

Be responsible for the safety of its employees and the safety of each of its Subcontractors and its respective employees. This includes the responsibility for following, and for its Subcontractors to follow, all rules, regulations, standards, guidelines, and recommendations of OSHA; providing safety training to its employees, Subcontractors, and its Subcontractors’ employees; ensuring the proper use and type of equipment utilized in performing the Services (consistent with OSHA); and the identification and avoidance of potential safety hazards associated with harvesting activities.
