Neither Toyota Tsusho Inc. nor XPO have the facts or the law on their side.  Toyota and XPO did, in fact, retaliate against driver Sergio Ceballos by banning him from Toyota and depriving him of his livelihood because of his union activity, speaking up against the working conditions he faced during the pandemic. Tragically, an XPO driver who delivered Toyota parts from Toyota Tsusho in Southern California has died from COVID-19, yet XPO continues to deny its drivers the rights and protections needed to keep them safe. Time and time again, XPO has been found guilty of misclassifying its drivers, continuing to violate the law with impunity, while courts and government agencies have established that  XPO drivers are employees, not independent contractors. We call upon Toyota Tsusho to hold XPO accountable for providing a livable wage, basic rights, and protections from COVID-19 for every driver.
